Our decision (determination) After considering the evidence, we have found that the complaint is outside our jurisdiction.

Reasons We are not free to investigate all complaints referred to us. What we can and cannot consider is set out in the Housing Ombudsman Scheme (the Scheme). For us to investigate the complaint we must be satisfied that the resident has a landlord/tenant relationship. We can only investigate complaints brought by a tenant of the landlord, or by their authorised representative. The resident is not a named tenant on the tenancy agreement. In order for us to consider the complaint, the resident would need to show permission from the tenant to act on their behalf as an authorised representative.

Despite requests, we have not seen any evidence that the resident has authority to represent the named tenant. As such, we have no jurisdiction to investigate the complaint.
